Water intrusion commercial property claim due to monumental Dec/Jan 2007 storm in Seattle. Truck Insurance Exchange (Farmer's Insurance Group of Companies) denied claim on all-risk policy. Truck being sued by McClincy's Brothers Floor Covering, Trial date has been delayed several times in King County Superior Court by Truck's two attorneys over the last year and a half. Trial judge now appointed is Chief Civil Court Judge Lum to commence 7/11/2011 with 6 man jury to determine coverage amount, previous civil Judge Bradshaw just reversed pre-trial judgment and determined coverage existed from the date of the claim. Pending bad faith claim by insured. Expert witnesses for defense (Truck) is Wetherholt & Associates, Lawless Construction & CMSI. Watch for national media coverage.
