Farmers refuses to pay for destroyed home

In 1985, Farmers insured, Best Plumbing, was called to service my neighbors house. I was not home at the time. Their plumber, without authorization, wandered onto my steep slope waterfront property and cut my pressurized sewer line at six locations, and then left without repairing the cuts or telling anyone what he had done. Sewage leaked for months and caused a landslide, damaging my home and property. The city of Seattle ordered me to stabilize the hillside. At mediation, Farmers offered nothing to repair the $1.2 million in damage. Prior to trial, I offered to settle for the cost to repair the damage, $1.2 million; Farmers said "no." In court, a judgment for $3.75 million was secured. Farmers then appealled and lost the appeal. Now Farmers has appealed to the Supreme court, complaining that the "statutory process" itself, for determining the reasonableness of damages by a Superior court Judge, should be struck down as unfair to insurance companies. This "statutory process" has been in place for at least 30 years in Washington state, and is prerequisite for a third party to sue an insurance company for bad faith conduct. The King County Assessor devalued my property more than $700,000, and designated it as destroyed property. This is an economic/legal strategy played out through the court system by insurance companies to wear out claimants, who typically get tired, go broke or grow too old to fight any more. It's at that time when the insurance company finally offers to settle for pennies on the dollar...a total abuse of the justice system and the public interest. They do it because they can, and they can because they have more money than you or I. Sadly, it's our money that fuels their behavior, and that really sucks.
