I was terminated in 2011 after going through a 4 month process from hell. Then just this Jan I received a voice message from the US Dept of Labor in LA wanting to ask me a few questions regarding Farmer's. Has anyone else received these calls? I have called back on numerous occassions and left a voice mail to call me back but have not heard anything more. Is there another class action?

The Department of Labor investigation is not part of any class-action suit that I'm aware of, just an investigation regarding the compnay's practices with employees regarding their day-to-day activities and overtime infractions they may have in their regular practices. Although it is likely due to the number of lawsuits filed and the allegations made regarding the company practices. I know they contacted Arizona FCR's and Texas FCR's.

If you speak with one of the DOL reps, they will likely ask you about your day, some questions regarding breaks, lunches and overtime. Send you some docs to fill-out/sign and return to them.

They apparently were inquiring about their normal day-to-day activities and how often they took their "breaks" and "lunches" and if those actually took place, if they were working during that time period or not. Of those I know that have been contacted, outside of the obligatory laugh, there were few(if any) that actually were given time for any federally-mandated breaks and little-to-no lunches actually taken. But you had better made sure your timecard said otherwise!

While I'm sure the company would not address, much less admit to their knowledge of these improprieties, I'm sure they will just wait for he DOL investigation to be completed, negotiate something on the punitive/settlement side and pay the reduced amounts with a smile knowing that doing so saved them a boatload in the grand scheme of things.

My opinion based upon experience.

I am currently out on stress disability but I can tell you that I have been accused of saying things I did not say and had been set up for termination. I work for the L.A.office and can tell you it's been HELL for 5 years. I'm way too distraught to go into details, but if anyone reads this posting and is trying to get together a class action lawsuit, PLEASE contact me. I would be happy to join in.
