Attorney review with car and renters policy, please help !

Posted by john doe
My car was vandalized and broken into about two months ago. At 3 am some one broke into my car and stole allot of valuables and decided to tear my cars electrical wiring and put water in my gas tank. I called farmers immediately and made a claim. I made a claim under my car and renters insurance. At first everyone was helpful and courteous but after much review a week passed by and decided that they need further investigation. 1 month later (car is still in the shop getting worse) an adjuster or special investigator came to my home and recorded my conversation about what happened. So now i have to deal with a claims adjuster on the car side and the renters side and now i have a special investigator to talk to as well. 2 weeks pass by and after calling the auto claims person for any info they give me the run around that i have to call the renters claim guy, the renters claim guy tells me to call the special investigator, the special investigator ask me to call them back. As you can see its just a battle going back and forth for any info. Another week passes by and after calling all three i decided to call each and everyone's manager, 3 more days pass by and finally got a call from a manager saying that the claim may take another moth before anything will happen. To my demise i also have been dealing with hertz rent a car about my rental, the first one had ants, the next one had major suspension problems, and finally got a decent one but had to battle them because since i was being under investigation that farmers stopped paying for it. I was furious my account went negative and when i tried calling them back (auto and renters people) they never gave me a call back till this day. no one has made an effort to say anything or call me back. After the special investigator assigned everything to someone else, everything changed to some one who would handle both claims auto and renters. She decided to take it to attorney review and now i have a date with an attorney to confess under oath and such. Can someone please help me with this issue or even if i can sue farmers for bad faith or never returning calls. I wanted to know also if i should call a lawyer to come with me to the meeting under oath. Thank you very much for any help.

(please email me back as i want to keep my identity a secret, please understand)

Farmers isn't buying your story. I use to work as an SIU Investigator for Farmers (6 years until I was terminated for a temporary medical issue related to my being diabetic). Either the Claims Adjuster referred your claim to the SIU or the SIU picked your claim out and advised the Claims Adjuster that they want to investigate the claim. You are now being asked to report to an attorney hired by Farmers, in his office with of course, an attorney, a court reporter and either the Claims Adjuster or the Special Investigator. I've sat in EUO's (Examination Under Oath) that have lasted 3-4 hours. They will ask you about everything. Criminal history, finances, judgments, bankruptcies. They will go into great detail about the facts of loss. later in the EUO, the attorney will take the Claims Adj/Investigator out of the room and ask if there are any other questions they want answered. It's your prerogative to have an attorney represent you. There's no doubt, Farmers will automatically think you're guilty if you have an attorney.
Keep in my mind, Farmers will tell you you're obligated to submit to the EUO as you have a duty to cooperate under the policy. If you don't submit to the EUO, they can deny your claim.
My previous manager, John Cassidy insisted I reopen an investigation after I made a determination there were no issues/concerns (Police advised they had no indicators on their investigation either). My manager told me to reopen the investigation and work on it until I found something on the insured. He was dying to report to Claims that it was insurance fraud.
You can call your Insurance Commission and advise them Farmers handling of the claim has involved no return calls, delays etc....
Be sure to have as much documentation as possible for your claim at the EUO (Receipts, paperwork etc...). Whatever you can to stuff down their corrupt throats.
I can assure you, they have already reported the claim to your state's insurance fraud agency, as well as, the NICB (National Insurance Crime Bureau). If ever, you have a future claim, an insurance company will see that you were being questioned about a previous claim.
You mind if I ask what state you're in?
Farmers is a highly unethical, corrupt organization. Once your claim is concluded, I would go elsewhere and get insurance. Just take a look at the postings on this site.
If you chose to attend the EUO on your own or with an attorney, you can always inquire about Farmers acting in bad faith.
I wish you the best and keep us posted.

Are you required to attend the EUO? What if you choose not to attend?

Well, they will deny your claim for not cooperating in thier investigation.

Is it best to retract an auto insurance claim before or after initially meeting face to face with the SUI assigned to your claim? I ask because I am in the process of starting a new job and do not want to deal with such an investigation, nor do I want it reported on my files. What is the proper procedure of an SUI? When does it go from investigation to accusation? Do they allow you any time to settle before they proceed to take you to court. My claim is for $2000 in damages and I don't think its worth the time or stress! Thanks

and that is why they are doing this probably. There really is no way to stop it other than withdraw the claim completely. But they will surely say it was fraud and cancell your policy.
