I was rear ended by a Farmer's policy holders 17 year old son. The truck belonged to the 17 year old but the father held the insurance. Farmer's took full responsibility for the accident. Today, I recieved an offer to settle case (first offer) $15,000.00. My medical bills equal $11,000.00 with general damages at $4,000.00. My confusion is should I take the offer or counter offer? The agent seems geniune in looking out for my best interest. She has not been difficult at all to work with. Thank you for any inside advice you may offer.

All kidding aside, there is simply no way to give you a decent answer-there are way too many variables that we dont know that we do need to know in order to answer your question. Was it soft tissue-Chiro or was there a substantial injury like broken back, arm, concussion. How long was the treatment. Was it treatment or diagnosis? ect...

They are not looking out for your best interests. Before you consider any settlement offer you should be talking with an attorney as well as a dr who has treated you as to the long term effects of your injuries with those kinds of medical expenses. Just know they will be using anything you have said already to build a case against you. You are the victim and yet they will try to distroy your credibility.

Oh I assure you that they are not looking out for your best interst. They are looking to "mitigate" your damages in any fashion that they can. That is why there is a difference in treatments and these are calculated differently. Simply stated, some injuries are not worth 3 times the medical and some are worth more then 3 times. Even if you get a good adjuster that actually cares, they are being micro managed by someone who probably doesnt.
