water damage claim as a result of roof leak by Farmers within the past year, please contact me , I may be able to help you.

Can you please help. here is what I sent them yet they denied this last appeal. which court should I sue and should I go pro se or seek a lawyer.

Denial: Erroneous denial of legitimate claim with people living in residence protected under senior citizen laws:
Farmers Insurance:
We have now taken over this case for recoveries of losses acquired since the first denial on November 2005 (claim number 1008036241). The examiner on the first denial was Lani Pham who when the family was approached, she did not have a full policy in hand, witnesses present. The examiner did not thoroughly research the day and event that the homeowners reported the loss upon which she would have seen that there was indeed heavy rains and wind that day.
This Present claim against farmers is in regards to the recent denial once again by farmers to legitimate our claim # 1008084683) ~ claims examiner Juan Escobar came to the scene the next day due to the fact that it was of dire emergency. The probable reason for the expediency was because on the prior claim it took farmers 6 days to get here which by that time the situation was different. The roof had collapsed and debris and electrical wires were not only in water but were exposed.
The property owner would like to get a copy of the records for all claims denied by Lani Pham, as they have reported her practice to the Federal Bureau of Investigations. We will continue to pursue this claim until you acknowledge your responsibility.
The first time farmers declined our claim was less than 6 months ago (November 2005), and yet we were never given an explanation of benefits. Lani Pham stated “we gave you a year to fix this (her supervisor present)” how ironic that she does not remember it was only 4 months ago. Any explanation of benefits now would be useless because It could easily be fabricated to show a denial. Nevertheless the time frame it took for Farmers to get here not only shows a lack of neglect and concern, but no longer gives Farmers an accurate and adequate assessment of true damage at the time of incident in regards to claim number 1008036241. Thus on that premise alone, It constitutes an unfair claims practice for failing to acknowledge and act reasonably upon communications of a situation.
Here are Farmers errors and thus breach contract:
• The family is determined that discrimation had existed under sec 2695.7 (a) because they were a minority, elderly, and not well versed in insurance practices.
• Sec 2695.7 (b) no explanation of benefits in writing, and if so should have been thus sent certified.
• Sec 2695.10 (C) our claim was denied without first obtaining or waiting for our pictures to develop, nor an estimate done by a contractor which we paid.
• Neglect of emergency action is a factor that we will if necessary litigate for the entire property value of the home unless this appealed is acknowledge for its present value.
One the night of the event:
I had explained to the help point area that the whole floor was wet and slippery and that the power plugs were in water. I could have slipped and you would have to pay for injuries yet you allowed the residents to stay in their homes not legitimizing the danger of exposed electrical wire which upon review runs across the roof which could easily have electrocuted any of the persons in the home.
This was reported by the homeowners to the National Elder Abuse Hotline, and now assigned a case worker to follow up. The center was notified because Farmers left the property owners to fix the problem themselves. Basically, Farmers abandoned a family in need. That will be prominent if taken to court.
Farmers did not act in good faith towards our home, nor did it take in consideration that the insured – Aida Abaniel is a senior citizen and by law has rights and protection against unsafe living conditions. In conclusion Lani Pham put a stipulation and time frame without referring to any laws or provisions and arbitrarily imposed her own criteria for denying the claim. Because the family was willing to work with farmers on the cost, Lani Pham assumed that they did not know their rights. Kindness should never be taken for weakness.
This will be our last and final appeal for demand of reimbursement. Otherwise, we will be forced to take this to a jury trial for entire property value of the home including mental, emotional, and elderly abuse compensation.
